WILLIAM MATLOCK

  

William Matlock was born abt 1795-1802 TN. William married Mary Berry. William died Jan 14 1827

Fishers Prairie AR. Mary Berry Matlock stated in her application for pension for service of her

husband that she married William 27 Jan. 1819 Territory of Arkansas, Hempstead Co. She stated

that he died 14 Jan. 1827 at Fishers Prairie, Ark. Mary M Matlock died 1873 and is buried in the

James Buchanan Cem, Nashville, Davidson County, Tennessee. Elm Hill Pike, Nashville, Tennessee

1825 July 18 W. Matlock vs The Heirs of George Berry, Dec'd. On petition of William Matlock and

Mary his wife, heirs of George Berry, Dec'd, it is ordered that David Berry, Drury Walls, and Mary

his wife, Robert Berry, James Berry, Thomas Berry, John M Buford and Mary his wife, Daniel Walls

and Elizabeth his wife,  and all persons interested in said Estate appear at the next July Term of

this court and shew cause if any they have why the property belonging to said Estate shall not be

sold and it is further ordered that a copy of this order be published in the Arkansas Gazette six

1832 Circuit Court Term, 1832 [Territory of Arkansas-Hampstead County] David Berry, Thomas Berry

and others heirs at law of George Berry Complainants vs William Hickman & others Defendants “The

said Francis McLelland as administrator aforesaid, and a certain Hiram Smith, that said Basil

Berry, who was a brother and one of the heirs at law of said George Berry, deceased after entering

into said fraudulent agreement, and before the same was carried into execution, some time in or

about the year 1822 or 1823, died, having first made or published his last will and testament,

leaving his wife, Margaret Berry, sole executor thereof; that at the time of the decease of the

said Basil Berry, no distribution whatever of the estate of the said George Berry, deceased had

been made; that the said Francis McLelland, administrator as foresaid, delivered the said negro

slaves to said Wm. Trimble, administrator as aforesaid, without any authority whatever, and said

Trimble received the same without having any authority for that purpose from said Complaintants,

or any of them; that the said Margaret Berry, widow and sole executor of the will of Basil Berry

deceased, died in the meantime leaving a will, and having appointed Wm. Matlock and Ibby Berry

executor and executrix thereof; that said Ibby Berry, executrix, as aforesaid appointed,

intermarried with a certain Henry Duty, that said Wm. Trimble delivered the said negro slaves to

the said Wm. Matlock as executor of the said will of the said Margaret Berry. That said Wm. Matlock

died intestate, having said negroes in his possession at the time of his death, and that a certain

Joshua Fuquay with Mary Matlock, the wife and widow of said Wm. Mathlock, deceased, and as

administrator and administratrix as aforesaid, took into their possession the said negoe slaves

aforesaid; that they remained in the possession of the said Joshua Fuquay and Mary Matlock until

December in the year 1828, when the said Joshua Fuquay delivered the said slaves, to-wit: Daphney

and her children, to-wit: Lewis, Monroe, Aaron, Maria and Alfred and also the said negro boy,

Harry, into the possession of a certain Robert Musick and John Berry, one of the Complainants named

in the said original bill, (first having taken a bond of indemnity from said Robert D. Musick and

John Berry), that whilst said Negro slaves were in possession of said Robert D. Musick and John

Berry, and shortly after they had acquired possession of the same, as aforesaid, said Musick for the

purpose of defrauding the Complaintants out of their interests in and to said negroes last mentioned,

and without any color of right, set up a claim to said negroes, by virtue of a pretended purchase of

an interest in them of the said Robert Berry, a brother, and one of the heirs at law of the said

George Berry, deceased and also of the interest of a certain Thomas O. Berry, and John F. Berry, sons

and heirs at law of Wm. Berry, deceased, who was also a brother and heir at law of the said George

Berry, deceased and combining with said defendant, Wm Hickman, to prevent the said Complainants from

having distribution of the said estate of said George Berry, deceased and to prevent them from

obtaining or recovering their respective, distributive share thereof, and prevent them from deriving

any benefit there from, pretendingly sold said negroes to Wm Hickman, and delivered them into his

possession for the fraudulent and iniquitous purpose aforesaid, and without receiving any real and

bona fide consideration therefore, and that said Wm. Hickman in collusion with said Musick and for

the purposes aforesaid, received of him the said negroes, to-wit; Daphney and her said children,

to-wit: Lewis, Monroe, Aaron, Marie and Alfred, and also the negro boy, Harry, and the said negroes

from that time until and at the time of exhibiting said original bill of complaint, remained and

then were in the possession of said Wm. Hickman, in the Counties of Hempstead or Lafayette in the

Territory of Arkansas.

 1 GABRIEL S MATLOCK born abt 1826 AR. In 1848 Gabriel was named in his Grandfather's Will :

"Gabriel Matlock and Margaret Matlock, my two grandchildren, have one equal share with those

I have given my land and the balance of my Negroes".."Gabriel Matlock and Margaret Matlock my

two grandchildren which is the two I have mentioned heretofore, one equal share of all my

household and kitchen furniture and stock of all kinds and all grain fodder and everything

belonging to me at the time of my death " Gabriel married first Mary McKay, second Mrs.

Elizabeth J Morman May 5 1859 in Tippah Co MS and 2nd Molly May on March 9 1873 DeSoto Co MS.

Mary A Matlock died June 15 1856, Elizabeth J Matlock died Dec 7 1870, Molly Matlock died July

28 1886, and Gabriel died Aug 23 1893 all four are at Hickory Flat , Benton Co MS

  4 Thomas S Matlock born Feb 11 1877 Holly Springs MS. Thomas married Mary Jo Nance.

    Thomas registered for the World War I Draft on Sept 12 1918 from Shelby Co TN.

    Thomas was tall with a stout build with brown eyes and gray hair. It was noted that

    Thomas's left thumb was off. Thomas named his sister Maggie as his next of kin.

    Thomas died Feb 1 1946 Shelby Co TN, Mary Jo died Nov 28 1951 Shelby Co TN, both

    are buried in the Memorial Park Cemetery, Memphis TN.
