   Sir:  I am pensioned under the above certificate number, because of the

service of the soldier named.  I was his wife during the Civil War.

    I am "married in 1866" years of age, having been born Jan. 19, 1836 in

Franklin Co., Alabama.

    I am entitled to the increase of pension provided by the first section of

the Act of September 8, 1916.

 Deposition A

 

Case of Mary M. Scott, No. 707640

 

    On this 14 day of December, 1900, at 5 mi. from Annona, county of Red River,

State of Texas, before me, E. E. Hoge (?), a special examiner of the Bureau of

Pensions, personally appeared Mary M. Scott, who, being by me first duly sworn

to answer truly all interrogatories propounded to her during this special

examination of aforesaid claim for pension, deposes and says:

 

     I am 64 years of age; my post-office address is Annona, Tx.  I have no

occupation, only I work some times and live here near my son.  I am the widow

of Lawson Scott who was in the United States service in time of the war. My

brother-in-law wrote to me that my husband was in Co. H 24 Mo. Inf.  I had

forgotten the name of his service.  He was never in any other regiment that I

know of.  He was never in the Confederate service that I know of.

 

     My maiden name was Mary Matilda Matlock.  My father's name was Wm. Wash.

Matlock who died at "Cedar Grove or Fair" (Note:  this appears to have been

marked through with a single line) in Franklin Co., Ala. when I was 18 months

old.  My mother (dead) afterward married Sampson Williams, now dead.  We moved

to Independence Co., Ark. in 1850 and lived at different places in that county,

Sulphur Rock & Oil Trough were our postoffice addresses in that co. 

 

     I was married to Jackson Sturch at or near Sulphur Rock, Ark. in 1854. I had

four children by him and raised three, biz: Joicy E. who married Louis Childress

and now lives at Hudson in Little River Co., Ark.  Her husband works in the timber

and about saw mills.  The second child is James Jefferson Sturch who lives here. 

The third child is Wm. B. Sturch who also lives here.  My said first husband A. J.

Sturch or Andrew Jackson Sturch was in the Confederate Army, don't know what

company and regiment.  He went into the army in fall of 1862 and was out only four

months when he died near Van Buren, Van Buren Co., Ark.  He started home, he having

measles and stopped at a house and died.  The census name when he died was

"Churchwell" I think.  I don't know the distance from where he died to Van Buren,

but it was in the neighborhood of the latter on the road leading to Ft. Smith.  His

death occurred Jan. 4, 1863.  I was not there when he died nor when he was buried. 

He was buried in a graveyard near where he died I think.

 

     A man named W. W. Fife, now dead, was one who was with my husband when he died. 

Fife lived not far from Oil Trough, but I don't know just where and that was his

postoffice address.  John Hurt was another who was with Jackson Sturch my said

husband when he died.  Hurt used to live above Oil Trough but I have since heard that

he lived between Elmo & Newport, Ark.

 

     There are no others now living who were present when Sturch died.  I do not

remember the names of any other members of Sturch's Co. though Bob Akins (or Ecals

or Akles) (dead) of Sulphur Rock, Independence Co., Ark. was Capt. of the Company. 

I can't remember the names of any other members of the company.  Don't remember

name of the Col. of the regiment.  The company was made up in Independence Co.

principally, and from both sides of the river at Sulphur Rock.  My said husband did

not have any doctor, and I don't know whom I can furnish as witness to his death,

only John Hurt if he can be found would know.  There was another man - name forgotten

- who knew about it and he, if living, can testify.  He was old and in bad health 8

years ago.

 

     I was about 18 years old when I was married to A. J. Sturch and had not been

married before that time.

 

     I lived in the same neighborhood where I was married till after Sturch died. 

The Coker family, Willis family, Hogan family and the Cassious (?) were our

neighbors when I was married to Sturch.  I remained the widow of A. J. Sturch from

his death till Feb. 8, 1866 when I was married to Lawson Scott near Sulphur Rock in

Independence Co.  I was married to Scott by Parson ---- Jernigan (dead) a Methodist

preacher who lived on a farm adjoining that of Mr. Scott.  License for our marriage

was obtained at Batesville, Independence Co., Ark.  My half-brother F. M. Williams,

now dead, and my half-sister, now dead, and W. W. Sturch of Oil Trough, Independence

Co. were present when we were married.  I don't recall others.  I now remember that

Columbus Sturch of Oil Trough was another who was present at the marriage.  I now

remember that Elihu Edwards of Newark, Independence Co., Ark. was a neighbor and was

well acquainted with Lawson Scott at the time.  Some people who did not know my

husband's name very well called him Lawrence.  Mr. Jernigan who married us called

him Lawrence but that was not right.  Wm. Scott's family called him Laws for short,

but his father James Scott sometimes called him Lawson.

 

Mr. Scott has no brothers living, and only one sister, Mrs. Harve Duggen of near

Sulphur Rock, Ark.

 

     If Lawson Scott had any other name than as stated I never heard of it.  He had

lived near Sulphur Rock for a good many years before the war and he had never been

married before he was married to me that I ever heard of.  I had one child only by

Lawson Scott and her name is Mary E.  She is now the wife of James A. Davidson of

near Annona, Tx.  I have no child under 16 years of age by the said Lawson Scott. 

He deserted me on Christmas night in 1867.  We were then living within three miles

of Sulphur Rock.  He went away with a woman named Nancy Reeves, the widow of Burl Reeves. 

She had parted from her Reeves husband before she and Lawson Scott disappeared together. 

Burl Reeves was living near Sulphur Rock, Ark. about 3 years ago when I heard from him

last.

 

     Lawson Scott and myself had parted about two months before he went away with the

Reeves woman.  He had been going with the Reeves woman, and mistreated me and my

children.  He was on his father's place and I went to another place, to my step-

father's. He told me to leave.  He was drinking man.  Lawson Scott and myself were

never divorced.  No divorce suit was ever brought that I ever heard of.

 

     I will also state that this Nancy Reeves had a husband before she married Reeves. 

I can't remember the first husband's name, but he was an orphan boy and died in the

army.  They were married near Sulphur Rock.  Her (Nancy's) maiden name was Vernon.

 

     No sir, there was never any divorce talked of between myself and Lawson Scott. 

I heard that he was going to leave with Nancy Reeves, and I asked him about it and

he never denied it.  In the spring of 1868, the first spring after Scott went away,

I moved down on White River about 7 miles away from where I had formerly lived and

remained there about 20 years. The postoffice address was Oil Trough and a part of

the time at Elmo.  This was all in Independence Co.  I then went over into the edge

of Stone Co., Ark. and remained about three years.  My postoffice address there was

"Marcello".

 

     I then came to this neighborhood which was eight years ago and have remained

here ever since.  I have no property, but some chickens.  I live in a little house

owned by my son.

 

     (Question)  Where did Lawson Scott and Nancy Reeves go when he deserted you

in 1867?

 

     (Answer)  I do not know.  It was said that they got on a boat and went down

White River.  He came back to his father's about 5 years after he left us.  He

only remained a week or two and went away.  Some said he went to Missouri.  I did

not see him the time he came back to his father's.  I head that the woman Nancy

Reeves came into the neighborhood while he was there and that they went off again

together.  Scott was never in the neighborhood of Sulphur Rock after that that I

ever heard of.  I have never remarried since the said Lawson Scott deserted me.

 

     (Question) As to Nancy Reeves's first husband can you not remember what his

name was?

 

     (Answer)  I can't remember only his Christian name was Henry (?).  No, his

name was not Reeves.  No, I never heard her second husband called John.  I always

heard him called Burl.

 

     (Question)  What was the condition of Lawson Scott's health when you were

married to him?

 

     (Answer)  His health was good when I married him and while I lived with him

and he had no sickness that I know of.  I heard him say that he had been subject

to "side pleurisy" in Indiana when he was a child, but he never had pleurisy while

he lived in Ark. at the beginning of the war or afterward that I know of.  No, he

did not have pain in side, cough, sores on legs when I married him or at any time

that I know of after I came to know him which was before the war.  Henry Scott,

his brother, had a sore leg before he was grown -- got it poisoned his mother said,

wading in the water.  The disease went to Henry's lungs and he died.  No, Lawson

Scott was not hard of hearing after the war or at any time while I knew him.

 

     (Question) By whom can you prove the death of A. J. Sturch?

 

     (Answer)  John Hurt of Elmo, Independence Co., Ark.  I don't know of anyone

else now living, only Bob Akles of Sulphur Rock, well now my son says he is dead.

 

     (Question) How can your marriage to Lawson Scott be proven?

 

     (Answer)  By the marriage record and by Wesley W. Sturch of Oil Trough,

Independence Co. and Columbus Sturch of same place.  Mr. Jernigan who married

us is dead.

 

     (Question) By whom can you prove that Lawson Scott was not married before

he married you?

 

     (Answer)  Wesley W. Sturch, Elihu Edwards, Harvey Dugger and wife and James

McDonald all of Sulphur Rock ought to know.  Edwards, however, lives at Newark,

Ark.  The parties know that I was never divorced from Lawson Scott. Burrel Reeves

of Sulphur Rock would perhaps know a good deal about me while I lived in

Independence Co.

 

 (Question) Who were your nearest neighbors at Oil Trough, Ark. where you say you

lived for 20 years after Scott left you?

 

 (Answer) Kelley Helsey, B. Y. Cook  The widow of Wm. Horn, Epherains Deurrington,

--- Draper, and Wm. John Heinden are families.

 

 (Question) Who were your nearest neighbors at Marcello in Stone Co., Ark.?

 

 (Answer) Wm. Halliburton & family, John Gray & family, --- Monday & family, and

Jim York & family.

 

 (Question) Who have known you since you came to Tx.?

 

 (Answer) George Crabtree and his sister, Mrs. Dicey Davidson.  They knew me back

in Ark. in 1874.  Mrs. Wm. Mahon knew me about 20 years ago in Ark. and she has

known me ever since I came to Tx.  J. F. Dugger of Clarksville, Tx. knew me in

Ark. even before I was married the first time. 

 

 I do not want to be present or represented at the examination of this claim by you. 

I do not want to be present or represented at any further examination of my claim.

 

 (Question) Where did Lawson Scott your husband die?

 

 (Answer) The postmaster at Salem, Ark. wrote me that he died at Sturkie, Ark.  I

never had a picture of my said husband, but his sister Mrs. Harvey Dugger of

Sulphur Rock has his picture.  Mrs. Dugger is not friendly to me in my opinion for

she has failed to answer letters written to her in regard to this case.  I head that

he Lawson Scott died Mar. 1, 1896.  May claim for pension as the widow of Lawson

Scott is under the new law or under act of June 27, 1890.  I understand that the

contents of this deposition and my answers to you questions are correctly recorded.

Deposition of Elzira Deckard in Regard to Mary Matilda Matlock

 

July 11, 1901 at Newark, Ark.   Taken by C. W. Newman (?)

 

     I am 72 years of age; my post office address is Newark, Ark.  I am the widow of

the William Deckard who was a Confederate soldier during the late Civil War and died

of a wound received at the battle of Shiloh.  I have remained his widow ever since

and am a pensioner of the State of Ark. as such.  I came to this county from Tenn.

in 1850 and have lived here ever since.  I knew this claimant well when a young girl. 

Her maiden name was Matilda Matlock and her mother was the wife (2 marriage) of

Sampson Williams.  I lived within a short distance of them.  'Tilda married Jack

Sturch, a neighbor, before the war.  Jack went into the Confederate Army and died in

the service.  'Tilda afterward married Laws Scott, a neighbor after the war.  Lawson

Scott went into the Union Army and it was when he came back after the war that he

married the widow Sturch, Andrew Jackson Sturch's widow, this claimant.  Scott and

she did not live together long, but she had one child by him if I am not mistaken. 

He deserted her and went off with Nancy Vernon (unreadable) but who also married Bill

Noad and afterwards Burl Reeves.  He and Nancy went up into Mo. together and have

never seen them since.  But I have understood that they did come back and live a while

up above Sulphur Rock.  I did not see them.  Scott was a bad man; no one could say a

good word for him.  On the other hand Matilda Sturch was a good woman and respected by

everyone.  After Scott deserted her she moved with her family over to Oil Trough bottom,

just across the river, to her mother who during the war had moved with her husband,

Williams, over there.  From that time I never have seen her but have understood that

she moved to Tex.  Scott and claimant were never divorced so far as I ever heard.

 

     (Question)  You speak of Matilda Matlock marrying Andrew Jackson Sturch and

afterward Lawson Scott.  What do you know personally about that?

 

     (Answer) I was not present at either marriage, but knew of each at the time as

neighborhood events generally known and discussed.

 

     (Question) What do you know about the death of Jack Sturch?

 

     (Answer) In the same way; neighborhood talk and general understanding.  I know

she, claimant, was his widow when she married Scott.

 

     (Question) Did claimant ever marry again after Scott left her?

 

     (Answer) If she did, it was after she left here and went over to Oil Trough and

I never heard that she did.

 

     I am not related or interested.  Have heard the foregoing read and it is correct.
