I Mary Matlock do hereby make and publish my last will and testament and hereby ?

and making Void all other wills by me at any other time.

 

1st I will to my son John Wesley Matlock a certain tract of land containing 31 1/2

acres acres transferred to me by Solomon Copeland. Also a tract of 20 acres

transferred from James White to me all of which I do will to the said John Wesley

Matlock.

 

2nd I do here by will to my daughter Rachel Fry a certain tract of land transferred

from James White to Hannah Matlock which was was granted to be by Court of Humphries

County Tennessee

 

3rd I do will to my son Edward Lane Matlock a certain tract containing 20 acres

transferred to me by Thomas Jones as Sheriff of Benton County.

 

4th I do here by will to my son John Wesley Matlock, Rachel Fry, and Elizabeth White,

one bed and one bed closet

 

5th I do will that my son John Wesley Matlock do sell the balance of my property and

after paying the Doctor Bill he then divides the proceeds of said property equally

between John Caswell Matlock and Mary Evans.

 

In Witness where of I do to this my last Will set in my hand and affix my seal this

16th day of October one thousand, eight hundred and fifty one.

Matlock, all of Benton County, for the sum of one hundred dollars in hand paid by Matlock, for a tract of land containing twenty acres, lying in District 1, on the waters of Eagle Creek, it being part of an entry granted to John Matlock by No. 17090, beginning at the southeast corner of the tract, runs north 54 poles in the east boundary of the tract, then west 59 poles, then south 54 poles in the south boundary of the tract, then east 59 poles to the beginning. of Norris & Brothers & others vs William MATLOCK and Thomas B. McElwn [McElwee].

The suits revived against Charles L. King and John B. Eldridge, administrators.

(Bradley Co, TN, Ch Ct Min, 1-156) In this suit Margaret Knight wife of Levi H.

Knight by her next friend Jesse P. Thompson, claimed she has right to the Thompson

tract of land mentioned in this cause, 10 Mar 1847 (Ibid 275)

Margaret KNIGHT - Was a femme covert 26 Feb 1851 when she filed suit by her next

friend, John Thompson, vs Thomas B. McElwee, John P. Redmond, Levi H Knight, William MATLOCK & William Hounshell. On 20 Sep 1836 Jesse Thompson, the brother of Margaret

devised 320 acres of land on ten mile creek in Meigs Co, TN to his father and mother

for life, remainder over to the complainant Margaret and her two sisters and the heirs

of their bodies. In Jun 1839 the three sisters divided said land and Margaret received

as her portion 106 acres. In Dec 1839 while the tenants for life were in occupation of

the land, Levi H. Knight sold said 106 acres to David Hounshell, since deceased The

court determined that Margaret was entitled to the land as her separate property apart

from her husband. (Bradley Co, TN, Ch Ct Min,2-16)

CAMDEN: Funeral services for Thomas L. Matlock, Sr., 73, formerly of McKenzie were

held Monday, February 17 at 11:00 a.m. in the Oakdale Chapel in Camden with Bro.

Bennie Akers officiating. Burial was in Eastview Cemetery. Mr. Matlock passed away

Friday, February 14 at St. Thomas Hospital. He was born on May 26, 1928 in McKenzie

to the late Vollie and Ollie Matlock. He was retired from maintenance. Survivors

include his wife, Laverne Matlock of Camden; two daughters, Donna Spence and Sandra Blalock, both of Camden; two sons, Thomas L. Matlock, Jr. of Eva and Richard W.

Matlock of Camden; two brothers, John William Matlock of Moncks Corner, SC and

Clifford Matlock of McKenzie; two sisters, Mina Lou Golden of Mississippi and

Stella Lois Matlock of Memphis, seven grandchildren and three great-grandchildren.

At the April term, 1797, the court met at the house of William Matlock in Elizabethton,

and soon after the minutes of the court record meetings held in the courthouse. When

this building was completed or of what material it was constructed is not known, but

it was probably of logs and stood on the public square. Elizabethton (Sycamore Shoals) played a significant role in 18th century history as the setting for some of the most dramatic events to occur in the expansion of America's western boundary. Here was established the FIRST PERMANENT SETTLEMENT OUTSIDE THE ORIGINAL 13 COLONIES, AND THE WATAUGA ASSOCIATION - THE FIRST MAJORITY RULE SYSTEM OF AMERICAN DEMOCRATIC GOVERNMENT - WAS FORMED IN 1772. In 1796, Tennessee attained statehood , Carter County was named for Landon Carter, and the county seat, Elizabethton, for his wife Elizabeth Maclin Carter.

the Capture of Charleston. Affiant was given at the surrender of the city. James

Bradley was not taken Prisoner because he Capt Saunders and others of the Co. was at

1843 Oct 8 To the Honorable the Legislature of the State of Tennessee now in session in

the town of Nashville, the undersigned petitioners would respectfully solicit your Honorable Body to take into consideration the property passing a law to compel all Iron Masters to keep their stables and feeding places enclosed with a good and sufficient

fence so as to keep the stock of other persons from gathering around such work as

neighbors living adjacent some of the Iron Works suffer great damage from their stock

1848 Jan 7 WILL of William Matlock Davidson County TN....This cause was received before Hon. Nathan Green, William B. _ and Robt. J. McKinney, Judges of the Supreme Court, on this 7th day of January 1848 upon the Transcript of the record of the Chancery Court at Franklin from which this cause came by appeal, when it appeared to the Court that in the month of February 1845 William Matlock died in Davidson County where he resided. That in the year 1843 the said William Matlock made and duly executed a paper writings as and for his last will and testament, which was signed by him and to which Edward R. East and Robert Buchanon became subscribing witnesses that by said paper writing the said William Matlock disposed or purported to dispose of all his estate real and personal in the manner set forth in a paper writing numbered A exhibited in the record with the deposition of Edward H. East with the exception that it provided that, that portions of his estate left to the children of Benjamin Matlock should be subject to a life estate in their mother the widow of the said Benjamin. It further appeared that said paper writing remained in the possession of the said William Matlock or that he supposed and believed that it remained in his possession unrecorded and un-cilled until his death but that soon after the death of said William Matlock diligent search was made for said paper writing in such places as it might have been expected to have been found but that the same could not be found, whereupon and upon the facts and circumstances developed in this cause in the proof the Court is of opinion that the said paper writing was suppressed or destroyed by some person without the authority of said William Matlock's knowledge so that the same could not be produced in the County Court and the Court being further of opinion that in such a case a Court of Chancery has jurisdictions to set up and establish said paper writing as the last will and testament of said William Matlock and that the same was the last will and testament of said William Matlock the Court doth therefore declare that said paper writing was the last will and testament of the said William Matlock and that the same was in substance and effect as follows, viz:

 

I, William Matlock of the County of Davidson and State of Tennessee, being of sound mind and memory do make this my last will to have my body decently buried and pay all my just debts and in the second place I will and bequeath unto my granddaughter, Margaret Matlock

a Negro girl by the name of Atsey about eleven months old exclusively above all the rest

of my children and in the third place I will and bequeath unto my daughter, _ Stanfield twenty-five cents and in the fourth place I will unto my daughter, Mary Stuart, twenty-

five cents which is all I wish thern to have of my estate and in the fifth place I will that all my land that I own and the balance of my Negroes be equally divided between Nicholas Matlock, John Matlock, Gabriel Matlock, James Matlock, Simpson Matlock and Sarah Holleman and Benjamin Matlock's heirs to have one child's share subject to a life estate however in the same in favor of the widow of said Benjamin Matlock and that Gabriel

Matlock and Margaret Matlock, my two grandchildren, have one equal share with those I

have given my land and the balance of my Negroes to and I also will to my sons and to Benjamin Matlock's heirs and to Gabriel Matlock and Margaret Matlock my two grandchildren which is the two I have mentioned heretofore, one equal share of all my household and kitchen furniture and stock of all kinds and all grain fodder and everything belonging

to me at the time of my death and in the last place I appoint John Matlock and Simpson Matlock my two sons my Executors to carry into effect this my last will and testament as witness whereof I do hereto set my hand and seal this 25th day of April in the year of

our Lord one thousand and eight hundred and forty-three which was signed by said William Matlock and published by him in the presence of said East and Buchannon who became subscribing witnesses thereto. It is thereupon ordered adjudged and decreed that the said paper writing set forth as aforesaid be set up and established as the last will and testament of William Matlock, deceased, and that said Executors be allowed to be qualified as such under said will or in case they should fail so to become qualified that such other person as may be by law entitled be allowed to administer on said estate of said William Matlock with the will annexed. And it is further ordered that all the cost of this cause

be paid out of said William Matlock's estate. State of Tennessee, Davidson County Court February Term 1848. The final decree of the Supreme Court of the State of Tennessee establishing the will of William Matlock, deceased, was duly certified by the clerk of

said Supreme Court to this Court and ordered by the County Court to be entered of record

as the last will and testament of William Matlock dec. whereupon Simpson Matlock and John Matlock the Executors named in said will came into court and gave bond in the sum of three thousand dollars with Robert Buchanon and G. S. Matlock their securities and qualified according to Law ordered that they have Letters Testamentary granted them.

Company A was one of only three companies that had been mustered into service when

Alvan C. Gillem was appointed colonel of the Tennessee Infantry May 13, 1862. It was

first reported in the Official Records on June 10, 1862, in Brigadier General Ebenezer Dumont's Independent Brigade, District of the Ohio. On October 8, 1862, the 10th

Tennessee Infantry was reported as part of the Post Forces of Nashville. Although it

was assigned to various army corps during the war, including service as a Governor's

Guard, the 10th mainly served garrison duty at Nashville as well as guarding nearby railroads and the construction of the Nashville and Northwestern Railroad. In April,

1865, it was ordered to Knoxville to form part of the 4th Division. It was mustered

out at Greenville, Tennessee June 23, 1865

CASWELL MATLOCK according to his tombstone was born Nov 10 1786. It is believed that Caswell married Mary Merrick. Mary was born March 10 1790. Caswell's tombstone states

that he died May 10 1826, Mary died Oct 18 1857. Both are buried in Benton Co TN.

Caswell can be found on deeds 1n Dickson Co TN, and the 1820 Humphreys Co TN Census.

state of Tennessee for divers good causes and considerations me hereunto moving have

made, ordained, authorized, nominated and appointed and do by these presents make

ordain, authorise, nominate & appoint Pritchett and _ merchants of Nashville, Davidson county and state of Tennessee my true and lawful Attorney, for me and in my name and

for my own proper use to ask, demand, sue for, recover and receive of Joseph Coleman

(or his successor) District Paymaster of the State of Tennessee all such sum or sums

of money debts and demands whatsoever, which are now due and owing to me the said

Charles B Metlock by and from the United States, for my services as a Sergeant in Capt. Francis S Ellis’s company from the 3 day of _ 181?, as per my certificate of service herewith. And to have, to use and to take all lawful ways and means, in my name, or otherwise, for the recovery thereof by attachment, arrest, distress or otherwise, and to compound and agree for the same, and a quittances or other sufficient discharge, for the same for me, and in my name, to make, seal, and deliver, and do all other lawful things, and acts whatsoever, concerning the premises as fully and in every respect as I myself might or could do were I personally present at the doing thereof. John CHOATE - Died in 1834 leaving a will naming Elenor Choate as Executrix. On 22 Oct

1845 Joseph Choate petitioned for division of the slaves. Elenor Choate has now died.

Other petitioners are Jeremiah Smith, Nelly Ann Smith, James Smith, Edwd Smith and Mary

Ann Smith who are minors and James Choate is appointed their guardian. (Dickson Co, TN,

Cir Ct Min, AA-no #) Another petition was made in February 1848 by Joseph Choate, Luke MATLOCK and his wife Elly formerly Choate, S. J. Choate, John C. West and his wife Lucretia, formerly Choate, Peter Choate who petitions for the benefit of Joel Hardin who purchased his share, and Thomas Smith, Jeremiah Smith, Nelly Ann Smith, James Smith,

Edward Smith and Mary Ann Smith, children of Ailsy Smith, deceased. John Choate was the father of the petitioners and died about 1834 leaving a will. Ailsy Smith was a daughter

of John Choate. She and her husband, Edward, are both dead. All of their children except Thomas are minors (Ibid B-195)

I William Matlock of the County of Dickson and State of Tennessee, being in a low

state of health but of a sound mind and a disposing memory do make and publish this

as my last Will and Testament hereby revoking and making void all other wills by me

at any time made.

 

First I direct that my funeral Expenses and all my just debts be paid as soon after my death as possible out of any monies that I may die possessed or may first come into the hands of my Executrix and Executor herein after named.

 

Secondly I give and bequeath to my beloved wife Miriah, during her natural life or widowhood all my property if every description which shall embrace the four acre

tract Deeded to me by Elizabeth Acuff on which I now live and also the interest

which is a third part of the Hundred acre tract lying adjoining the town of Charlotte

that I purchased of F M Brinkly and Nancy Coffee the boundaries of said tracts can be

had by reference to the Deeds made to me by said Elizabeth Acuff, F W Brinkley and

Nancy Coffee which are registered in the Registers Office of Dickson County. It is my

will and desire that my said wife have the said property to enable her to raise and

school my younger Children who have but little Education and for her support and

comfort, but should my said Wife marry then in that case my Land and what of the

personal property may be left or remain is to be sold and divided equally among my

wife and all my children, my wife taking a childs part. Should any of my property that

she may feel able and willing to spare and at the death of my said wife should she

remain a widow all my property shall be sold and equally divided among all my children.

 

Lastly I hereby appoint my trust friend Thomas NcNeilly and beloved wife my Executor

and Executrix of this my last Will and Testament. In Witness whereof I do to this my

The Dickson County Press of August 12 1886 wrote: "Mrs. Minerva Corlew Matlock, who is

at the home of her father, Mr. John Corlew, about one mile east of Charlotte, is in the last stage of consumption, and the doctors think cannot live  but a few days."

Ray Matlock of Charlotte; three half-sisters, Mrs. Allene Caldwell of Dickson, Mrs.

Irene Fowler and Miss Ruby Matlock, Charlotte. The remains are at Dickson funeral home. Funeral Service from the Mount Lebanon Methodist church, Monday, April 21 at 2 p.m.

This is a muster roll for Captain Benjamin Cherry's Regiment, Lauderdale's Battalion, Tennessee Mounted Infantry, Cherokee War (Spies). They were mustered in at Ross landing

31 Oct. 1837 for six months. Most of the men were from the civil district nine area of Franklin County and communities of Alto, Decherd, Roark's Cove. Some of the men lived

in the part of Franklin that became Coffee and later Grundy.

Charles Matlock (also spelled Midlock & Medlock) submitted his will on June 23, 1796. Charles named Susanah Midlock (his wife) and John Midlock (his son) as the executors

of his estate. A reference to his "children" indicates that there were other children

in his family. Joseph Braddy & Henry Hawkins witnessed the will. Did Isham Bradley

marry the daughter of this Charles Matlock, who could have been named for her mother?

This indenture made this thirteenth day of September in the year of our Lord one

thousand seven hundred and ninetysix between Jacob Kennedy of Grainger County and

State of Tennessee of the one part, and the Heirs of Charles Matlock Deceased of

the County and State aforesaid of the other part Witnesseth: That for and in

consideration of the sum of Two hundred Dollars to him the said Charles(?) Kennedy

in hand paid by the said Charles Matlock in his lifetime and before the insealing

and delivering of these presents, the receipt whereof is hereby acknowledged hath

bargained and sold in fee simple and confirmed unto Susannah Matlock Relict of said

Charles Matlock and Executrix of his estate, a certain tract or parcel of land

containing by estimation two hundred acres be the same more or less, granted to the

said Kennedy by the State of North Carolina patent bearing date 12th day of July 1794

No. 636 lying and being in the said County of Grainger on the waters of Richland Creek BEGINNING at a post oak and turning due west one hundred and forty poles to a postoak, thence south twenty-six degrees west one hundred and eighty-two poles to a blackoak

thence due east nineteen poles to a pine thence said course two hundred poles to a

black oak thence said course' twenty-six poles to a black oak, thence due north one

hundred and sixty poles to a stake thence due west twenty-six poles to the BEGINNING together with all appertainances to the said land belonging or in anywise appertaining

free from all hindrances of any person or persons lawfully claiming the same TO HAVE

AND TO HOLD the land and premises with every part or parcel thereof free from all encumbrances of mortgage doners by or from me the said Jacob Kennedy or any other

person or persons whatsoever and to be to the only proper use and behoof of the said Susannah Matlock during her lifetime and then to pass to the Heirs Elect of the said Charles Matlock, their heirs and assigns forever agreeable to his last will and

testament and the said Jacob Kennedy do hereby promise, covenant and agree to and with

the said Executrix, Susannah Matlock that I have the full and only title and lawful authority to sell, convey said land and premises and. do by these presents convey the

fee simple estate thereof from me the said Kennedy my heirs to her the said Susannah Matlock for life, and the heirs elect, their heirs, Executors, Administrators and

Assigns forever, agreeable to the intent and meaning of the last Will and Testament.

of the other part WITNESSETH, that the said John Matlock for and in consideration

of the sum of two hundred dollars in hand paid the receipt whereof is hereby

acknowledged, hath and by these presents doth grant, bargain and confirm unto the

said John Haley, his heirs and assigns forever a certain tract or parcel of land

lying in the county of Grainger on the north side of Holston River containing one

hundred acres, be the same more or less bounded as follows; BEGINNING at a sycamore

and stone on the bank of the River Joseph Ore's corner tuning north eighty-eight

degrees east forty-six poles to a hickory, thence north sixty-three degrees east

to a post oak, then north seven degrees east fifty-eight poles to a lake, thence

west until it strikes the river, thence the different meanders of the river to the BEGINNING with all and singular the woods waters, watercourses, profits, commodities, hereditaments and appurtenances whatsoever hereunto belonging or appertaing and the reversion and reversions, remainder and remainders, rents and issues thereof and

appointed in & by said will refuse or neglect to take upon themselves the execution thereof.  It is therfore ordered by the court that Sarah MATLOCK the widow of the

Deceased & James Moore Esquire have leave to administer on all & singular the goods

& chattels, rights & credits of the deceased with the will annexed, Enter into Bond

& give Jeremiah Chamberlain & Samuel Clark their securities in the sum of five

thousand Dollars – and the said administratrix & administrator took the necefsary

oath.

eight hundred and Sixteen.  Between Charles MATLOCK, Henry MATLOCK, John MATLOCK,

William MATLOCK heirs, and representatives of John MATLOCK Deceased and citizen of

the state of Tennessee of the one part and Joseph Beeler of the county of Grainger

and state aforesaid of the other part witnesseth that the said Charles MATLOCK, Henry MATLOCK, John MATLOCK and William MATLOCK for and in consideration of the sum of

seventeen hundred Dollars to them in hand paid the Receipt whereof is hereby

acknowledged hath and by these presents doth grant Bargain Sell alien enfeoff and

confirm unto the said Joseph Beelor his heirs and assigns forever all the undivided Interest in common of them the said Charles MATLOCK, Henry MATLOCK, John MATLOCK and William MATLOCK of in and to a certain Tract or parcel of land lying and being in the county of Grainger on the North Side of Clinch mountain in the east fork of Williamses creek being part of a Six hundred acre Tract originally Granted to Thos Harrison
