The Creek War of 1813-1814, by Halbert & Ball - Chapters 9-11 THE KIMBELL--JAMES MASSACRE
     

On August 31, 1813, Mary James, daughter of Abner James, was up late caring for a sick

family member. Young Isham Kimbell was helping her. The dogs outside began to bark

furiously. Mary blew out the candles. They could hear the sound of running feet.

Yet, the next day, inexplicably, the families still didn't return to Fort Sinquefield.

At 3:00 pm on September 1, 1813, Ransom Kimbell was away from the house. Abner James and

a man named Walker who was visiting were near the house. Suddenly, the house was surrounded

by Red Sticks! Hostiles led by the Prophet Francis descended on the house in a fury. James

and Walker were shot at but untouched. They managed to get Abner's son Thomas age 14, and

his daughter Mary away from the melee and the four of them fled to Fort Sinquefield.

Young Isham Kimbell had seen what the Indians were doing to his family and immediately ran

way, grabbing a younger brother who was in blacksmith's shop. The boys stayed away from the

road. Indians saw them and fired at them but both were untouched. They made it to a creek

and while crossing, Isham fell. When he gathered his senses, he realized his brother was no

longer there. Nothing more was ever known of what happened to that child. Isham continued on

to the stockade. He heard the hostiles but was able to conceal himself from them. Meanwhile,

two men at Sinquefield, on hearing shots, had ventured out; they were Thomas Matlock and

John O' Gwynn. They found the exhausted teenager and took him to the Fort.

Everyone else -- 14 people in all -- in the Kimbell house was savagely clubbed and scalped.

The house was pillaged and burned.

aforesaid, at my place of residence, near Fort Stoddert, and at other places in the county

were Thomas Matlock..Etc., who being duly sworn on the holy evangelists, deposed to the truth

of the statements signed with their hands and marked U to Z and from A2 to Z2, and from A3 to

Matlock residing in the same hereby certify that we are well acquainted with Robert Tharp that

we believe him to be near one hundred years of age that he is reputed and believed in the

neighborhood where he resides to have been a solider of the revolution and that we concur in

that opinion.

PENSION APPLICATION

On this the 14th day of June AD One Thousand Eight Hundred and Fifty Two, personally

appears before me, J W Morris, an acting Justice of the Peace in and for said County

Pheba Matlock, widow of Littleberry Matlock, who being duly sworn deposeth & says

that she is the widow of Littleberry Matlock, that she is now about sixty five years

of age - that her said husband Littleberry Matlock was a private in the company

commanded by Captain Daniel Renshaw in the regiment of Militia commanded by Colonel

 ___?___. all under the command of General Andrew Jackson in the War with the Creek I

ndians. That her said husband was drafted on or about the month of Sept. AD One

Thousand Eight Hundred and Fourteen in Retherford County, State of Tennessee for the

term of three months, that he actually served in said war for the term of three months

and was honorably discharged in the month of Nov. AD One Thousand Eight Hundred and

Fourteen in Retherford County in the State of Tennessee, and that he has now no written

discharge, all of which will appear by the Muster roll of said company. the said Pheba

Matlock would further state that she was married to the said Littleberry Matlock on the

29th day of April, AD One Thousand Eight Hundred Fifteen, that her name before marriage

was Pheba Tharp, that she and Littleberry Matlock lived together as husband and wife

until the death of said Littleberry Matlock which happened on the 8th day of October

AD One Thousand Eight Hundred and forty four and that she is now a widow, and that she

is now a resident of Franklin County in the State of Alabama. She makes this declaration

for the purpose of obtaining the Bounty Land to certain Officers & Soldiers who have been

engaged in the Military Service of the United State passed September 28th 1850. Sworn to

& scribed before me the day & date above written and I hereby certify that I believe the

said Pheba Matlock to be the Identical person she represents and that the said Littleberry

James H. Medlock, age 79, died at his home at Dutton on Nov. 7, 1956, at 7:40 a.m. following

a heart attack. The funeral will be at the Shady Grove Church with Rev. Crawford and Rev.

Robert Allen conducting. Burial in the church cemetery will be in charge of Scottsboro Funeral

Home. Surviving are the widow; seven daughters, Mrs. Daisy Partridge, Trenton, Ga., Mrs Wheeler S

mith, Knoxville, Mrs. John Brown, Trenton, Ga., Mrs. Violet Headrick, Mrs. Tom Wynn, Mrs. Willie

Headrick, All of Dutton, Mrs. Marshall Hawn, Chattanooga; three sons, Elmer Medlock, Pisgah;

Arthur and  Millard Medlock, both of Dutton. He also leaves eight brothers and two sisters and

several grandchildren.

 

The Chattanooga (TN) Times - Thursday - October 10, 1963:
Dutton, Ala. - Mrs. Sarah Emma Medlock, a former licensed midwife who delivered hundreds of

babies on Sand Mountain, died at her home here Monday. She was 82. Mrs. Medlock, who has 162

descendants, was the mother of 16 children, 10 of whom survive. Her husband was the late

James H. Medlock, who died in 1956.

 

Surviving are seven daughters, Mrs. Daisy Cunningham and Mrs. John Brown, both of Trenton, Ga.;

Mrs. Wheeler Smith, Knoxville; Mrs. Vilos Headrick, Mrs. Willie Headrick, and Mrs. Tom Wynn, all.

of Hodge, and Millard Medlock, Dutton; one sister, Mrs. Dot Flemming; 51 grandchildren, 93

great-grandchildren, and eight great-great-grandchildren. Funeral services were held Tuesday at the Old

Shady Grove Church in Dutton, where Mrs. Medlock was a member. Officiating ministers were the Revs.

Don Roden and Lonzie Bynum. Word-Yates-Bolton Funeral Home directed.

James Lowery Allison and his wife Mary.  In 1858, James and Mary Allison, along with five of

their children, moved to Hood County, Texas.  He and son James H. and W. L. Rippetoe bought

a mercantile business.  Mary died 5 Oct 1860 and is buried in the cemetery at Acton, Texas. 

James Lowry sold out to Mr. Rippetoe, returned to Alabama around 1861, and married Margaret

Rorex and have 5 children. Following Margaret’s death, James Lowry married Mrs. Emily C.

Medlock Burch. There were no children from this marriage. James Allison died on 20 Oct 1877

and is buried in the Allison Cemetery near the Allison home place in Big Coon.

1931 Nov 5 LEWIS MATLOCK, 49, FOUND PINNED UNDER OVERTURNED TRUCK (The Alabama Courier)

Lewis Matlock, aged 49 farmer of the Beam, community, was within a mile of his little

home late Saturday afternoon when his truck left the road, pinning him beneath the truck.

Passersby found Matlock pinned beneath his overturned truck with his neck broken. Paul

Ramsey, of Boonshill, was first to reach him, and Mark Harrison assisted in freeing the

body from the wreckage and him to his home. Matlock was a native of Lincoln county but

had resided for a time in the Bethel community near Athens, Ala. Mr. Matlock is survived

by his wife, who before her marriage was Miss Nina Hatcher; four daughters, Mrs. Leslie

Smith, Mrs. L. Robinson, Belle Mina, Ala, and Mary and Alma Matlock; two sons, Woodard

and Frank Matlock; brother, Walter Matlock; three sisters, Mrs. J. J. Bedwell and Mrs.

J. W. Pike, both of Nashville, and Mrs. Ace Witt, of Huntsville, and his mother, Mrs.

Mary Frances Matlock. Funeral services were held at 9:30 a. m. Monday morning at

his residence, conducted by Elder D. E. Mason. Burial was in Bethel cemetery near Athens,

Monroe County
to the Sheriff of said County greeting whereas Edward L. Smith hath complained

on oath to me Asa Hammond, a justice of the peace in and for the county aforesaid,

that Richard P. Chisholm is justly indebted to Edward L. Smith and Henry L. Allen

partners in trade by the name of Smith and Allen in the sum $185.01 an oath having

also been made that the said Richard P. Chisholm is about to remove himself out of

this state so that the ordinary process of law cannot be served upon him and the

said Smith and Allen having giving bond and security according to the direction of

the acts in such case made and provided we therefore command you that you attach

the estate of the said Richard P. Chisholm if to be found in your county or so much

thereof responsible on security as shall be of value sufficient to satisfy the said

debt and cost according to the complaint and such estate so attached in your hand so

to secure or to provide that the same may be liable to further proceedings thereupon

to be had at the circuit court to be held for said Monroe County at the courthouse of

said county on the 3rd Monday of March next so as to compel the said Richard P.

Chisholm to appear and answer the above complaint of the said Smith and Allen. When

Estate of          }   This day came W. P. Leslie, the admr of said Estate the same having

been appointed for a final settlement of said Estate.  Also, came John DeLoach as gdn ad

litem for all the minor heirs of said Estate, & in open Court, consented to wit as such gdn

ad litem - and the notice required by a previous order of this Court having been given - and

the account being examined, audited & stated - It appears that said admr is chargeable with

the sum of three thousand & ninety 70/100 Dollars; that he is entitled to credit for the sum

of seven hundred & fiteen 79/100 Dollars -leaving a balance in hands of said admr on this

settlement, of two thousand three hundred & seventy four 91/100 Dollars - To be distributed

as follows to wit:

Sophia D. Ray has complied with the terms of said sale -

Estate of          }   This day, came Rufus C. Torrey, the admr of said Estate & filed his

petition in due form, selling forth that said Estate is solvent & praying for an order of

distribution of the following personal property belonging to said Estate to wit: one negro

woman named Victoria, a negro boy named Albert, a negro girl named Barbara & a negro girl

named Adaline, together with some household & Kitchen furniture, a few cattle, hogs, & c.,

among the following named heirs of said Estate, to wit: Elizabeth Moore, Sophia D. Ray, 

Eliza Medlock, & Lucius Medlock all of full age; also, the minor heirs of Walter Medlock

decd, to wit: Lucretia, Martha, Mary Jane, Lucinda, Nancy & Lucius Medlock.  It is therefore

ordered by the court, that Jas. M. Agee, Wm. R. Agee, A. J. Robertson, Wm C. Sowell & Robt. I.

Draughon, who are disinterested persons & residents of this county, be, & they are hereby

appointed commissioners to divide said property nto five equal shares - one fifth to Elizabeth

Moore, one fifth to Sophia D. Ray, one fifth to Eliza Medlock, one fifth to Lucius Medlock &

one fifth to the above named minor heirs of Walter Medlock, decd, after having first taken an

oath to make said distribution fairly & Impartially, if the same can be done, & to make due

return of their proceedings in writing, signed by them, to this court, on or before the third

Monday of May next - It is further ordered, that said Petition be recorded for further reference.

Estate of           }   This day comes R.C. Torrey, the admr of said Estate the same having

been appointed for a final settlement of said Estate and the notice required by a previous

order of Court having been given.  Also, came John DeLoach as gdn administrator for the minor

heirs of Walter Medlock, decd, who if living, would have been a distributee of the Estate of

said Nancy. And no other person appearing to contest said settlement.  And the account being

examined, audited & stated.  It appears that said admr is justly chargeable with the sume of

ten thousand & forty, 67/100 Dollars - paid by him in Confederate Treasury notes - and that he

is entitled to credits for sums paid out & allowed as proper charges against said Estate, to

the amount of nine hundred & twenty-seven 34/100 Dollars - Leaving a balance in his hands to

be distributed, amounting to nine thousand one hundred & thirteen 23/100 Dollars - and that

the said admr has the further sun of $59.00 in ? subject to distribution among the said heirs -

 

It is therefore ordered, adjudged & decreed by the Court, that the said admr do pay over to wit:

SETTLED AN OLD FEUD


Birmingham, Ala., Sept 19 - Alexander Matlock and George Turner, prominent farmers in Shelby

County, and brothers-in-law, yesterday settled an old feud by a duel to the death.. They met

in the public road and fired 5 shots each. Turner fell mortally wounded and Matlock escaped.
