Joseph Hudspeth was born abt 1760 in Surry Co N.C. Joseph was the son of

George Hudspeth Joseph married first Agatha Hutchins on Nov 1 1784 in

Surry Co N.C. Agatha was the daughter of John and Alice Stanley Hutchins.

Joseph Married 2nd Ann Margaret Shemwell May 14 1804 Logan Co KY. Joseph

Hudspeth died March 5th 1809 Warren Co KY. After the death of Joseph, Ann

Margaret Shemwell Hudspeth married Michael Holland and Moved to Todd Co

KY. Margaret Holland died Feb. 14, 1856 aged 84 yrs. 4 months daughter

of James Shemwell born St. Charles Co. Maryland

She is mentioned in her father's will made in 1824 as Agatha Hudspeth.

Agatha Hutchins Hudspeth's family were Quakers, and Agatha was disowned

at the Deep River Monthly Meeting on 1-11-1784 for marrying out of unity.

(Disowned by the Quakers, but obviously not by her family).

Anna Margaret Shemwell Hudspeth Holland is buried in the Pilot Knob Cem.

in Simpson Co. along side her son. Her gravestone says "Anna Holland

died Feb. 14th 1856 aged 84 years and 4 months". Anna Margaret's  vital

statistic is in Logan Co. KY and it gives her parents as James Shemwell

and that she was born in St. Mary's Co. Maryland. Her father died in

Granville Co. North Carolina leaving a will and mentions her as his

daughter.

1787 22 Feb - Joseph bought from David HUDSPETH 15 acres for 10 pounds;

1787 Sept 5 - Joseph witnessed a deed from Thomas CAIN to George BROOKS.

1794 Oct 10 - Joseph sold to Airs HUDSPETH for 50 pounds, 100 acres;

"This indenture this tenth day of Octbr in the year of our Lord one

thousand seven hundred and ninety four between Joseph Hudspeth of the

County of Surry and State of North Carolina and Airs Hudspeth  Junr.

of the county aforesaid of the other part witnessed that for and in

consideration of the sum of fifty pounds cash to him in hand paid

before___? and delivery of these presents the receipt wherein he doth

hereby acknowledge, have bargained, sold and by these presents do

bargain, sell, and confirm into the said Airs Hudspeth jr. one certain

tract or parcel of land "situate" lying and being in the aforesaid county

of Surry and being bounded by the North Fork of Deep Creek to wit:

beginning at a white oak Joshua Brown's corner and runs north on his

line  thirty six chains to a black oak on Elmore's line thence east

twenty five chains to black oak then south forty chains to a post oak

thence west twenty five chains to a stake thence to the beginning

containing one hundred acres to have and to hold the  the above

mentioned land and premises, with every of the appurtances unto the said

Airs Hudspeth jr. his heirs and assigns forever together with every part

 _________.and Airs Hudspeth  junr. to peacefully  enjoy for himself and

his heirs forever and I the said Joseph Hudspeth my heirs & c. do hereby

warrant and forever defend the right of the same unto the said Airs

Hudspeth jr his heirs and assigns forever and clear from the challenge

claim and demand of me, my heirs & c. or any other person or persons laying

any just claim right or title to the said bargained and sold land above 

mentioned. In witness where unto the said Joseph Hudspeth hath hereunto set

his hand and affixed his seal the day and date above written. Signed and

Williams, Benjamin (X) Cain The above deed was proved the November term

1796 by the oath of George Hudspeth and ordered to be registered. Teste:

The full text of Joseph's will, executed 5 Mar 1809, proved in Warren Co.,

KY April Court 1809. Bequests to wife Anna, sons James, John, Thomas,

George, and Solomon, and daughter Polly/Dolly Donhoam. Executors: sons

John and Thomas and brother George Hudspeth. Witnesses: James Harris,

Michael Holland, guardian for James Hudspeth, and George Hudspeth, guardian

for Solomon Hudspeth, infant heirs of Joseph Hudspeth. A committee was

appointed to divide the land agreeable to the will.

Will book A. page 163 Warren Co. Ky. Written March 5, 1809 proved in April

Court 1809.

Inventory dated April 8, 1809

In the name of God Amen, I Joseph Hudspeth of the County of Warren and

State of Kentucky being in a very low state of health, but of sound mind

and understanding and calling to mind my mortality that it is appointed

once for men to die, I make this my last will and testament that is to

say first of all I resign my spirit into the hands of Almighty God who

gave it and my body to the grave to be buried in a Christian manner--next

I dispose of my worldly estate in the following manner that is to say after

all my just debts and funeral "expences" are paid. I bequeath to my loving

wife Anna one half of the plantation whereon I now live to begin at a cross

fence that is opposite to Hezekiah Hollands including all the improvements

on east side of said "fince" together with the part of my land that lies on

the east side of a line to begin with and run north to Aron Williams line 

and south to my own land during her state of widowhood then to return to my

son James and I ordain my wife Anna have one feather "bead" and it's

furniture, one cow and calf, one sow and pigs, 6 puter plates, one dish

and "beason" and one set of knives and tools. Likewise her saddle and

bridle and twenty pounds of the estate to buy a horse, one ewe and lamb of

my flock.

I decree Polly Donham have one feather bed and furniture, one cow and calf

one sow and pigs and one ewe lamb which she has received.

Also I ordain my son John have one hundred acres of land where he now lives

by him paying the State price fifty dollars, one cow and calf one sow and

pigs, one saddle worth five pounds and three sheep which he has received in

hand.

I ordain my son Thomas have one hundred acres of land where he lives by his

paying the state price and his lifting my bond to Samuel "Cottrell" for one

hundred dollars for the improvement of said land, one horse and saddle, one

horse and saddle, one cow and calf one sow and pig and three sheep which he

has received.

I will my son George have the balance of the four hundred acres whereof John

& Thomas has a part of the state price to be paid out of my estate, one old

horse down on Duck River with three white legs and a spot on the fourth knee,

one sow and pigs, three sheep and likewise his freedom at my " decease".

Item that my son Solomon have a sorrell filly with "blced face" now at home

which he now claims and one saddle which he has in his possession. Item that

the grainon the place and that in the ground remain for the consumption of

the family.

Item That the land whereon I live be equally devised between my son Solomon

and my son James when Solomon reaches the age of eighteen.

I will the balance of my person estate be sold at public "acktion" at twelve

months credit and the maney divided between all legateees. I also make this

my last will and testament and revoking all others as though they had never

been made. I do "amy" my sons John and Thomas and my brother George Hudspeth

executors of my estate whereon I have given my hand and "fixeth" my seal

this 5th day of March 1809"
